THIS AGREEMENT , made and entered as of the date of on-line connection, by and between South Central Wireless or South Central Telephone Association, Inc. dba SCTelcom, ("SCTelcom"), and the Internet access subscriber, ("Customer"), upon the following terms and conditions ("Agreement"), including any attachments and documents incorporated herein by reference.


TERMS AND CONDITIONS.

Definitions. The following definitions shall apply to this Agreement:
1. "Customer" and "Customers" shall refer to the Customer named below. To subscribe to SCTelcom Internet access services the Customer must be at least 18 years old.
2. The "Service" means any and all Internet access services and Internet related services provided by SCTelcom.
3. The "Effective Date" is when the Agreement is accepted by SCTelcom and hook-up of the Service has occurred which is when the Service is available for Customer's use, regardless of the status of Customer's equipment.
4. These Terms apply to the following website which will be individually referred to herein as the "Site." The following is also a list of the owner covered by these Terms. The owner will be individually referred to throughout these Terms as the "Company."

Use of Site.

1. Customer agree to use the Site in accordance with these Terms, as may be modified from time to time, and such other terms, conditions and procedures posted throughout the Site. Customer will at all times comply with all applicable international, federal, state, and local laws and regulations.
2. The Company reserves the right to suspend or permanently terminate the Site or Customer's access to the Site at any time, for any reason and with or without prior notice.
3. Customer's use of the Site is free of charges from the Company.
4. Customer agrees not to use the Site in any manner that damages or impairs the Site or interferes with the use of the Site by others, nor will Customer misappropriate or attempt to misappropriate any portions of the Site, materials, software, programs, code, or other information on or within the Site. Customer agrees not to create links to any portion of the Site without the Company's express written permission.
5. Customer may provide information to the Company through various links on the Site, for example, service request forms, links to contact the Company, email links provided for Customer to submit certain materials to the Company. This method of requesting services or otherwise contacting the Company is provided for the convenience of the Company's customers. Customer acknowledges and agree that the purpose of the Site is informational and for Customer's convenience and that the Site is not intended to create any commitments between the Company and Customer regarding the services

Company provides.
Copyright/Trademarks. All content included on the Site is protected by U.S copyright laws and portions of the Site may also be the subject of patent, trademark, service mark, trade secret, or other proprietary rights and laws, and constitute the proprietary information ("Proprietary Information") of the Company, its licensors, affiliates, advertisers or other third parties. Customer may not copy, modify, distribute, transmit, republish, create derivative works from, or display, the Proprietary Information contained on the Site. Retrieval of data or other content from this Site to prepare any collection, compilation, database or directory is strictly prohibited.

Links to Third Party Sites.

Any links or other references to third party web sites, including links to web sites of companies affiliated with the Company but that are not covered by these Terms, are not an endorsement, sponsorship, or recommendation of the third parties or the third parties' information, ideas, products, or services. Customer's conduct and transactions with respect to third parties, including Other Company Affiliates, referenced on this Site are subject to the terms and conditions and privacy policies of such third party and are at your sole risk.

No Liability/No Warranty/Indemnity.

1. References to warranties on the Site, if any, are merely descriptions of warranty coverage that can be obtained for products and/or services offered by the Company. The terms of products and services, including warranty coverage, if any, are contained in separate contracts or other documents that the Company provides to Customer (with respect to telephone service some terms of service are regulated by state or other governmental entities) if Customer orders products or services through this Site. Product and service features, including warranty and maintenance descriptions, if any, contained on the Site, are subject to change at any time without notice. Customer acknowledges and agree that the purpose of this Site is informational and for Customer's convenience and that this Site is not intended to create any commitments between the Company and Customer or provide any warranties regarding the products or services provided by the Company.
2. Customer understands and agrees that use of this site is at your sole risk and is provided by the company on an "as-is" basis. The company makes no warranties of any kind, express or implied or otherwise including warranties of title, fitness for a particular purpose, merchantability or non-infringement regarding this site. With respect to consumers outside of Kansas , Oklahoma and business users of the site, the company expressly disclaims all warranties of any kind, express or implied or otherwise including warranties of title, fitness for a particular purpose, merchantability and non-infringement regarding the products or services referenced on this site.
3. Liability Limits and Indemnities For Kansas and Oklahoma consumers only: the company, its parent corporation(s), affiliated or subsidiary corporations (including the "other company affiliates" as defined in the endnote), or any of their respective officers, directors, agents, employees or independent contractors (collectively, the "company affiliates") are not liable for any errors, delays, inaccuracies, omissions or destructive properties contained in any of the materials contained in this site or any sites that are linked to, framed within, or otherwise referred to by this site. These Terms may change from time to time and it is Customer's responsibility to review them each time Customer visits the Site. Furthermore, additional terms and conditions may govern Your use of certain web sites or web pages within this Site and Customer agree that Customer's use of such other sites and pages will be in accordance with such additional terms and conditions. The Company reserves the right to refuse or discontinue use of the Site by any user or other party. All users of the Site must be at least 13 years of age. Customer and the Company agree that the statutes and laws of the State of Kansas without regard to conflicts of laws principles thereof, will apply to all matters arising from or relating to use of this Site.
